Public and Products Liability

This Policy covers your legal liability to pay damages to members of the public for accidental bodily injury or disease, and loss of or damage to property occurring during the course of your business. You can choose the indemnity limit you require, either £2,000,000 or £5,000,000. If you are an Approved Contractor of the Arboricultural Association you must have an indemnity limit of at least £5,000,000.
(Special facilities are available if a higher Limit of Indemnity is required e.g. £10,000,000)

You are responsible for:
the first £500 of each property damage claim arising away from your premises.

To help avoid claims arising out of the burning of tree debris on site the policy is subject to the following Warranty:

It is warranted that in respect of the burning of debris away from your own premises the following precautions must be taken on each occasion.
a
          fires to be in a cleared area and at a distance of not less than 9 metres away
            from surrounding property;

b
          fires are not to be left unattended at any time;
         a suitable fire extinguisher to be kept available for immediate use;
d
          fires to be extinguished not less than one hour prior to leaving the site at the
            end of each working day.

Employers’ Liability

This Policy covers your legal liability to pay damages in the event of accidental bodily injury or disease, caused to employees during the course of their employment.

 Injury to working partners may also be included, subject to additional premium.

Under the Employers’ Liability (Compulsory Insurance) Act 1998 employers are required to insure against their legal liability for injuries to employees happening at work.

Professional Indemnity

This Policy covers your legal liability to pay damages in the event of breach of professional duty by reason of any neglect, error or omission.

The first £500 of each and every claim is normally excluded - a higher excess may apply to larger risks.

You can choose the indemnity limit you require, either £250,000, £500,000, £750,000 or £1,000,000 in respect of any one claim. Under the ARBORPLAN policy, the indemnity limit is in respect of any one claim and there is no restriction on the number of claims during the period of insurance.

If you are an Approved Contractor of the Arboricultural Association, you must have an indemnity limit of at least £500,000.

Plant and Equipment

This Policy covers loss of or damage to plant and equipment owned by you, anywhere in the United Kingdom. Cover is normally on a  “new for old” basis in which case your sum insured should represent the cost of replacing all of your plant and equipment as new, without any deductions for age, depreciation or wear and tear.
However, if required, cover can be arranged on a "market value" basis.

You are normally responsible for the first £500 of each claim but this excess is sometimes higher in respect of Harvesters, Forwarders and other large items of Forestry Equipment

Cover can be extended to include:

Hired-in plant and equipment
b Continuing hire charges in the event that hired-in plant and equipment is lost or damaged
c The cost of hiring in replacement plant or equipment in the event of loss of or damage to your own plant or equipment and where there is a valid claim
d The cost of insuring the temporary plant or equipment

 As theft of tools and equipment is rife it is essential that you take adequate steps to protect your own property and, if applicable, hired-in plant and equipment. Therefore the Arborplan policy incorporates certain security requirements which will be found on page 5 of the Plant and Equipment proposal form.

Personal Accident (and optional Illness)

This Policy provides the following benefits, when injury occurs due to an accident, not necessarily related to your occupation:

1 Death   £10,000
2 Loss of one or more limbs or the sight of one or both eyes £10,000
3 Permanent Total Disablement from gainful employment of any kind  £10,000
4 Temporary Total Disablement from usual occupation £100 per week
5 Temporary Partial Disablement from usual occupation  £35   per week

This represents ONE UNIT of cover. You select the number of  units you require but the amount of benefit 4 must not exceed your average weekly income.

In respect of Illness only benefits 4 and 5 above apply

Benefits 4 and 5 are payable for a maximum of 104 weeks in respect of Accident and 52 weeks in respect of Illness although the Illness benefit can be paid for up to 104 weeks upon payment of an additional premium.
No payment is made for the first 2 weeks of disablement.
